XGear LLC SHIPPING AND RETURN POLICIES Shipping Orders will not be shipped until after 9:00 AM Pacific Standard Time of the next business day (Monday to Friday) following the day you place your order, excluding holidays and weekends. Change of day is considered to occur at midnight (12:00AM) Pacific Standard Time. All order shipments are subject to product availability and complete customer order, billing and shipping information being received by XGear. Shipments are also subject to change depending stock availability, weather restrictions or natural disasters. Upon processing and billing completion, orders are processed between Monday to Friday (excluding holidays). Shipping times only apply from the date and time that the order was shipped. Shipping times do not include customs delays. Orders purchased with the PayPal eCheck payment option may be delayed by up to nine (9) business days while PayPal clears the transaction. This is beyond XGear's control. U.S. & Canada Shipping Orders to U.S. & Canada will be shipped out via Standard or Express Services. STANDARD SHIPPING APPLIES TO CONTIGUOUS UNITED STATES AND CANADA ONLY. Orders destined for remote areas of Canada and U.S. may be subject to additional shipping surcharges and will be billed to customer. Canadian orders may be subject to import duties and taxes at port of entry. It is the customer's responsibility to incur this cost. International Shipping All orders to international locations will be shipped out via Express Services. Orders destined for remote areas of international locations may be subject to additional shipping surcharges and will be billed to the customer. International orders may be subject to import duties and taxes at port of entry. This cost is the customer's responsibility. Cancellations Change of day is considered to occur at midnight (12:00AM) Pacific Standard Time. Cancellations will only be accepted if a request is received before 12 midnight PST (Pacific Standard Time) on the day your order was placed. After 12:00AM Pacific Standard Time, a cancellation request is considered to be late and is not guaranteed to be honored. XGear LLC is not responsible for late cancellation notices. The customer will remain liable for all purchases, shipping and handling fees. Cancellations must be made via the web form. Returns EXTENDED HOLIDAY RETURN POLICY Returns will be permitted until January 12th, providing the following-
NON-FAULTY PRODUCT If for any reason you are not satisfied with any of our products, unused merchandise may be returned for an exchange or refund within 30 days from the date of receipt and subject to the provisions below: The product is mailed within 15 days of receiving an RMA form: No return packages will be accepted after this time period. Please return all products via insured parcel post. This shipping method allows for tracking of the package. XGear will not be responsible for lost or damaged packages. Allow 30-days turnaround time for an exchange or refund request to be processed. Shipping costs are not refundable. No refund will be made on the shipping portions of your order. We do not accept COD. The cost of initial shipping and all return shipping is sole responsibility of the customer. USA ORDERS: (Includes Hawaii, Puerto Rico, Alaska, Guam, US Virgin Islands): Ship to USA return address (indicated on order form). INTERNATIONAL ORDERS: (outside North America): Clearly mark both sides of the package, US GOODS FOR RETURN. If labeled otherwise, we may be asked to pay import customs, in which case we will refuse and it shall be returned to you. Ship to USA returns address (indicated on order form). CANADIAN ORDERS: Ship to USA return address (indicated on order form). BUNDLE PACKAGES: (ie: Buy EXOSkin iPad, get an EXOSkin iPhone 4 with the purchase): Refund or Exchanges will not be honored unless ALL ITEMS in the bundle package are returned. Damaged or Defective Products To ensure the highest possible quality, we fully inspect each product before it is shipped. We also fully guarantee all our products to be free from factory and workmanship defects. If any product is found to be defective or has been damaged during shipping, XGear needs to be informed immediately upon receipt of goods. Refund may be applied provided the terms and conditions listed in our Exchange and Return policy are met. XGear reserves the right not to exchange or refund items that are: damaged due to accident, misuse, abuse, product modification or negligence or damage resulting from the performance of repairs unauthorized by XGear. Price Matching XGear does not compete with its Distributors or Resellers by engaging in price matching. Instead, XGear establishes an MSRP (Manufacturers Suggested Retail Price) on merchandise, and provides it to its Distributors and Resellers for consideration. Product Warranty Limited Warranty XGear LLC warrants to the original purchaser that the product will be free from defects in materials and/or workmanship for the period of 30 days unless specified. The warranty period commences on the date of purchase from the authorized reseller/retailer. Your original purchase invoice, showing the date of purchase of the product from the reseller/retailer is your proof of the date of purchase. This proof of purchase is mandatory for any warranty issues. XGear at its option will repair or replace, at no charge, any part that XGear determines to be defective. To obtain warranty service during the warranty period, please fill out the form, noting you are seeking warranty service as your "Reason for Return or Exchange", to receive an RMA number and information on where to ship your product. This warranty shall not apply if the product has been damaged by abuse, misuse, negligence, accident, modification, tampering or by any other causes unrelated to defective materials and/or workmanship including acts of God. XGear’s warranty only covers product(s) made by XGear and does not cover third party product(s) sold by other companies. XGear LLC acknowledges that with normal use of products made by XGear, the purchased product(s) will provide satisfactory performance as specified by product performance literature. Repair or replacement as provided under this warranty is XGear's exclusive right. ANY APPLICABLE IMPLIED WARRANTIES, INCLUDING WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY LIMITED TO 30 DAYS FROM THE DATE OF PURCHASE AND ARE SUBJECT TO CONDITIONS SET FORTH IN THIS LIMITED WARRANTY. IN NO EVENT SHALL XGEAR BE RESPONSIBLE FOR INCIDENTAL DAMAGES RESULTING FROM THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTIES. This warranty gives you specific legal rights, and you may also have other legal rights, which vary from state to state, province to province, valid in the United States and Canada. Any shipping or other cost such as customs incurred costs, etc. from outside North America is the customer's responsibility. Exclusions and Limitations This limited warranty applies only to hardware products manufactured by XGear that can be identified by the "XGear" trademark, trade name, or logo affixed to it. This Limited Warranty does not apply to any non-XGear products. This will include third party products packaged or sold with XGear, any third party manufacturer may supply their own product warranty. All inquiries with regards to the product warranty may be directed to Notice to User XGear shall not be responsible for any damage, including consequential damage caused by defective goods, personal injuries, property damage or consequential economic loss. XGear does not guarantee suitability of its product for your application. Furthermore, XGear shall not be responsible for any damage, loss of data, or otherwise caused to the device when used with this product.
