Terms and Conditions

THE FOLLOWING TERMS AND CONDITIONS (THE "TERMS AND CONDITIONS" AND/OR "AGREEMENT") detail the terms and conditions for entering XGear's Holiday Contest Giveaway.

Please read these terms and conditions carefully before entering. By entering this promotion, all participants will be deemed to have accepted and be bound by the terms and conditions.

The Promoter (XGear) allows the participant to enter the promotional holiday giveaway for free and a random participant will be given an iPod Nano 6G.

By participating in the promotion, the participant, hereby releases the Promoter from any and all claims, damages or liabilities arising from or relating to the acceptance of any prizes in connection with your participation in the promotion.

Eligibility

The contest is free to enter.

Only one entry per person. Multiple entries are prohibited. In the event that multiple entries for an individual are identified, we reserve the right to remove his/her name from the contest.

Employees, officers and directors of Sponsor and its parent and affiliate companies, advertising and promotional agencies, as well as the immediate family (spouse, parents, siblings and children, regardless of where they live) and household members (whether related or not) of each such employees, officers and directors are not eligible.

Disputes

Subject to applicable law, participants agree that any and all disputes, claims and causes of action arising out of or connected with the contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants' rights and obligations or the rights and obligations of the Sponsor in connection with the contest shall be governed by and construed in accordance with the laws of the state of California, without giving effect to any choice-of-law or conflict-of-law rules.

Promotion Period

The entry date begins on December 3, 2011 at 1201 AM PST, and ends on December 31, 2011 at 11.59 PM (the "Promotion Period").
